Terms of Service

1. The Service

Postimony is a testimonial collection and display platform. We provide tools for businesses to request, collect, manage, and embed customer testimonials.

2. Accounts

You must provide a valid email address to create an account. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

You must be at least 18 years old and have authority to enter into these Terms on behalf of yourself or your organisation.

3. Acceptable use

You agree not to use the Service to:

• Send unsolicited emails to people who have not consented to hearing from you
• Fabricate, fake, or incentivise testimonials in a misleading way
• Upload malicious code, viruses, or harmful content
• Violate any applicable law or regulation, including anti-spam laws (CAN-SPAM, CASL, GDPR)
• Infringe the intellectual property rights of others
• Abuse, harass, or threaten other users or customers
• Attempt to reverse-engineer, scrape excessively, or disrupt the Service

We reserve the right to suspend or terminate accounts that violate these rules, without prior notice.

4. Your content

You retain ownership of the testimonials, customer data, and other content you upload (“Your Content”). By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and transmit it solely to operate the Service.

You are responsible for ensuring you have the right to share Your Content and that it does not violate any third-party rights.

5. Customer data responsibilities

When you upload customer names and email addresses, you are acting as a data controller and warrant that you have a lawful basis to contact each individual. We act as your data processor for that data. You indemnify us against claims arising from your failure to comply with applicable privacy laws.

6. Subscription and payment

Paid plans are billed monthly in advance via Stripe. Prices are displayed in USD. Subscriptions renew automatically unless cancelled before the renewal date.

Downgrading or cancelling your plan takes effect at the end of the current billing period. We do not offer refunds for partial months.

We may change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new price.

7. Free plan

We offer a free plan subject to the limits described on the pricing page. We reserve the right to modify or discontinue the free plan with reasonable notice.

8. Intellectual property

The Postimony name, logo, and all software are our intellectual property. These Terms do not grant you any right to use our trademarks or branding.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

12. Termination

You may cancel your account at any time from the Settings page. We may suspend or terminate your account for breach of these Terms. Upon termination, your access to the Service ends and we will delete your data within 30 days.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you by email and update the effective date. Continued use of the Service after changes constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Postimony operates. Any disputes shall be resolved in the applicable courts of that jurisdiction.
